Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about September 9, 2010, at the above addressed jobsite, an employee was exposed to falls while working from the elevated bucket attachment of a Lull 644B-42 rough terrain fork lift to power was a building. One feasible and acceptable abatement method, among others, would be to comply with AMSE/ANSI B56.6 - 2002 Safety Standards for Rough Terrain Forklift Trucks, which states "A rough terrain forklift truck shall not be used to lift people unless there is no other practical option." b. On or about September 9, 2010, at the above addressed jobsite, an employee was exposed to fall hazards in that an operator was not present to operate the controls and/or the platform was Terrain fork lift. An operator was not present to operate the controls and/or the platform was not equipped with controls. One feasible and acceptable abatement method, among others, would be to comply with the ASME/ANSI B56.6 - 2002 Safety Standards for Rough Terrain Forklift Trucks, which requires a trained operator be in position to control the rough terrain fork truck.n
