Section 5(a)(1) of the Occupational Safety and Health Act of
1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to [STATE HAZARD, E.G., CRUSHING HAZARD]:
Section 5(a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish employment and a place of
employment which was free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to being struck-by the
fork lift in the event of a turnover or thrown from the forklift:
a)Scrap Yard - On or about February 9, 2010 and at
times prior to, the employer failed to effectively
enforce the use of seatbelts by forklift
operators.  An employee was observed not wearing a
seat belt while operating a Hyster fork lift when
moving materials.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is to establish an effectively
communicated work rule and a progressive disciplinary policy
for failure to utilize seat belts.e
