Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to catastrophic release of ammonia from not having an inspection and maintenance program of their ammonia refrigeration system: (a) Location - Establishment: On or about 12/2/09, employees were operating an anhydrous ammonia refrigeration system without a mechanical integrity program for routine inspection and maintenance to ensure safe operation. Among other methods one feasible and acceptable means of abatement would be to follow section six of the International Institute of Ammonia Refrigeration (IIAR) Bulletin No. 110. Titled: Guidelines for Start up, Inspection and Maintenance of Ammonia Mechanical Refrigerating Systems.
