Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to provide a place of employment which was free from recognized hazards as follows: a.In the warehouse at Webgistix Corporation located at 880 Wigwam Parkway Suite 120 Henderson, NV 89014 a powered industrial truck (Raymond Model EASi R30TT, Serial #ET-E-04-13522) was used to lift an employee standing on a pallet to access stock on the upper shelves. The height of the top shelves is 232 inches. According to the manufacturer, the maximum elevated fork height of the above listed powered industrial truck is 204 inches. The manufacturer states that any platform that is used to lift employees on their powered industrial trucks must conform to ANSI 56.1 sec. 4.17. ANSI/ITSDF B56.1-2005 sec.4.17.2(c) states "Be certain that required restraining means such as railings, chains, cable, bodybelt(s) with lanyard(s), or deceleration devices, etc., are in place and properly used.". The employer did not provide a safe means for the employee to use the powered industrial truck to lift personnel to the upper levels of the shelving. A feasible means of abatement would be to provide the employees working in the warehouse a powered industrial truck with enough reach height to pull stock from the upper shelves without exposing the employee to a fall hazard or to ensure that stock in only placed on shelves that are within the reach height of the above listed powered industrial truck.rial
