Section 5(a)(1) of the occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall hazard while climbing rails of the scissor lift basket: a) On or about 04/07/10 at Route 440 & Amboy Avenue Bridge Deck: Employee was observed climbing the rails of a scissor lift basket to access the bridge deck, thereby exposing the employee to a fall hazard of approximately 14' to the ground. Sparwick Contracting Inc., was previously cited for serious violations of this Occupational Safety and Health standard or its equivalent standard, 5(a)(1) which was contained in OSHA Inspection Number 313701583, Citation #1, Item #1, issued on 11/19/2009 with respect to a work place located at Littletown Road, Parsippany, NJ 07054 and became a final order on 12/16/09.
