At the time of
the incident, a spill guard was installed under the portable metal
atmospheric tank which
contained wash water, sludge and hydrocarbon.  Adequate precautions were
not taken
to prevent the ignition of flammable vapors to include eliminating static
electricity
through proper bonding and grounding.

29 CFR 1910.119(l)(1):  The employer did not establish and implement
written procedures to
manage changes to process chemicals, technology, equipment, and
procedures; and
procedures; and, changes to facilities that affect a covered process:
a- Hess Port Reading Refinery, Dimersol - On 04/23/10 a frac tank being
used during
the final water wash and drying of the R-2203 caught fire and ruptured.
At the time
of the incident, tank contents included wash water, sludge and
hydrocarbon.  MOC
10-1462-22 (waterwash R-2203 and dryout prior to startup) approved on
02/03/10
failed to address build up of flammable vapors in the tank and potential
for static
electricity.  In addition, the MOC did not address the installation of a
spill guard
berm under the frac tank along with proper grounding and bonding.
Hess Port Reading Refinery was previously cited for a violation of this
Occupational Safety and Health standard or its equivalent standard, 29 CFR
1910.119(l)(1), which was contained in OSHA Inspection number 311917009,
Citation 1, Item 25, issued on 05/13/09, with respect to a workplace
located at
750 Cliff Road, Port Reading, NJ 07064.  The citation became a final order
on
12/24/09.
