General-duty citation text
29 CFR 1960.8(a): The head of the agency did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to Mycobacterium tuberculosis: On or about February 11, 2010, and times prior thereto, Officers were placing prisoners, with potential cases of Mycobacterium tuberculosis, into holding cells. Officers were not required to have tuberculin skin tests (TST) annually as per the Centers for Disease Control (CDC) guidelines. One feasible and acceptable method of abatement would be to require annual tuberculin skin tests by all employees handling prisoners whom potentially have tuberculosis.
