Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
provide a place of employment that was free from recognized hazards that
were likely to cause
death or serious physical harm to employees in that:
The John Deere 304 H front end loader was used to lift employee(s) in the
bucket
of the loader to gain access to the rail cars. Employee(s) were exposed to
a
possible fall and/or crushing hazard. The John Deere 304 H front end
loader is
not  approved as a working platform.
Feasible means of abatement include, but are not limited to:
a) The Association Equipment Manufacturers safety manual for operations and
mechanics of wheel loader/tractor, page 21, states "Never use a bucket for
a
work platform or personnel carrier."
b) A scissor lift could be used as a working surface. That would allow
employees
to be elevated at the appropriate height to perform their work.
Abatement documentation is required for this item in accordance with the
requirements of 29
CFR 1903.19(d).
