Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and/or explosion: a.Proof Testing Area - On or about November 3, 2010, employees were not protected from the hazard of fire and/or explosion due to the Snail Bullet Trap not being properly maintained per the manufacturer's written instructions for daily and weekly preventative maintenance. An example of such maintenance is that the spray pattern of the spray bar was not being checked to ensure that the ramps and deceleration chamber were being properly wetted as is required on a daily basis. ABATEMENT NOTE: Among other methods, feasible and acceptable means of abatement would be to follow the manufacturer's written instructions for daily and weekly routine & preventative maintenance.
