Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and crushed-by hazards: On or about February 16, 2011, at a work place located at 2707 Oakwood Village Apt, Mesquite, TX; at least one (1) employee riding on a pallet on the forks of a JLG SkyTrack rough terrain lift truck was exposed to falling, struck-by and crushed-by hazards. Among other methods, at least two feasible means of abatement include but are not limited to: (1) Comply with the manufacturer's safety warning displayed on the equipment. "WARNING CARRYING PERSONNEL can result in death or serious injury. Only Lift or Lower personnel when using a work platform. Never move machine with personnel on the work platform." and/or; (2) Provide and utilize approved ladder according to manufactures instructions.
