Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling more than 4-feet to the
ground below while
working from rolling stock:
This violation most recently occurred on or about March 10, 2011, and at
times prior to, at
the workplace located at 9314 West Jefferson Boulevard, Dallas, Texas
75052 where at least
one (1) employee securing a rolled up tarp to the bed of a flatbed
trailer, aka the G5 Skin-
trailer, was exposed to the hazard of falling more than 4-feet to the
ground below.
Among other methods, one feasible and acceptable means of abatement
includes, but is not
limited to: perform an assessment of the employee's job and ensure that
they have received
adequate training and equipment to perform the job safely.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the
abatement date, the
employer must submit documentation showing that it is in compliance with
the standard,
including describing the steps that it is taking to ensure that employees
working from rolling
stock have received the training and equipment to perform the job safely.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck by and/or crushed-by hazards:
a) This violation was discovered on or about April 07, 2011, in building
(76) shipping
department, where employee(s) were exposed to struck-by and/or crushed-by
hazards while
working from Perry prefabricated mobile interior scaffolds that were being
moved by other
employees; and
b) This violation was discovered on or about May 26, 2011, in building
(198) receiving
department, where employee(s) were exposed to struck-by and/or crushed-by
hazards while
working from Perry prefabricated mobile interior scaffolds that were being
moved by other
employees.
Among other methods, one feasible and acceptable means of abatement
includes, but is not
limited to: following the guidance in the manufacture's manual titled,
Instructions for the
Assembly and SAFE USE of Perry Scaffolds and Scaffold Towers (ELITE AND
CLASSIC
SERIES ONLY). On page 4 under the title of Safe Use it states, "Never roll
a Perry Scaffold
while a person is standing on the platform". In addition, on page 8 under
the section titled,
Assembly of a Perry Scaffold Tower it states, "Do Not Roll A Perry
Scaffold Tower When
A Person Is On the Platform".
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the
abatement date, the
employer must submit an abatement plan describing the action it is taking
to establish,
communicate and implement written procedures to ensure that Perry
Scaffolds are not rolled
or moved while an employee is standing on the working platform.
