Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to unguarded points of operation on press brakes:
a) Press brake area - There was no minimum safe distance program for
employees who
operated the six hydraulic press brakes including the Darley 165 ton
brakes, the Darley
50 ton brakes, and the Accurpress brakes. There were no fixed guards on
any of the
brakes. On or about 5/4/10.
Feasible method of abatement: Provide tools for employees to use to keep
their
hands at least four inches from the point of operation and to train them
to properly
use the tools.
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT
CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN
AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR
1903.19.
