Vermont Statute, Title 21 Labor : Chapter 3. Safety : Occupational Safety and Health : 223. Duties: The employer did not furnish employment and a place of employment which was free from recognized hazards that would cause and/or would likely cause death or serious physical harm to employees in that employees were exposed to potential crush hazards and at times prior thereto, at ITW Food Equipment Group, LLC d.b.a. Hobart Corporation of 8 Industrial Parkway Drive, Unit 6, Hooksett, NH at 41 Church Street, Burlington Vermont. Location: ITW Food Equipment Group, LLC d.b.a. Hobart Corporation of 8 Industrial Parkway Drive, Unit 6, Hooksett, NH at 41 Church Street, Burlington Vermont Violation: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush injury hazards and/or pinch-point injury hazards from a powered industrial truck overturning or from the powered industrial truck operator falling off the same powered industrial truck (forklift), due to the fact that the operator restraint systems (seat belts) provided on the powered industrial truck were not used by the operator. An employee operating a Toyota forklift, model# 7FGU30, serial number 69137 was observed not wearing the seat belt provided. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and to effectively enforce the use of the operator restraint systems provided by the manufacturer of the forklift and/or additionally another feasible and acceptable abatement method to correct this hazard is to follow the safe operating procedures in accordance with ANSI B.56.1 2004, American National Standards Institute. VERIFICATION REQUIRED: 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
