Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Line 10 Oven - On or about 07/27/10, two employees were exposed to a 10 foot fall hazard to the deck below while climbing on the top step of a reinforced plastic step ladder while replacing a belt for the oven exhaust fan. Among other methods, one feasible and acceptable abatement method to correct this hazard includes using a ladder of sufficient height which does not require an employee to step or stand on the top step of a step ladder as specified in the American National Standard for Ladders, Portable Reinforced Plastic Ladders Safety Requirements, ANSI A14.5, Section 9.3.2, Climbing and Working Locations. NOTE: ABATEMENT DOCUMENTATION REQUIRED

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: a) Thermal Oil Room - On or about 07/27/10, five employees from Utilities operated the thermal oil system temperature beyond its maximum set point of 570 F to as high as 580 F on Unit 20. This temperature was above the initial boiling point of the thermal oil (574 F). The system high temperature shutdown, according to Tasty Baking, is to be set at 572 F. The high temperature shutdown was set at 600 F. The thermal oil industry recommends against operating above the boiling point to prevent a sudden depressurization, flashing/misting, and fire from loss of containment and an ignition source. b) Thermal Oil Room - On or about 08/24/10, five employees from Utilities were exposed to fire and severe burn hazards from the loss of containment of heat transfer fluid and fire hazards from natural gas fired heat exchangers within an enclosed room located within the baking complex without: operator training, written operating procedures, maintenance training, written maintenance procedures, a safety interlock inspection program, testing and calibration program, an equipment maintenance program, a hazard evaluation and control program and fire and emergency action plans as required by NFPA 30 Flammable and Combustible Liquids Code and NFPA 85 Boiler and Combustion Systems Hazards Code. Among other methods, one feasible and acceptable method to correct the hazard is to comply with the National Fire Protection Association Standards 30 Flammable and Combustible Liquid Code and 85 Boiler and Combustion Systems Hazards Code by developing an operator training program for startup, shutdown, normal and emergency operations, written operating procedures, a maintenance training program, a written and implemented fire and emergency action plan, a safety interlock inspection testing and calibration program, a program for equipment inspection and maintenance at intervals consistent with the type of equipment used, service requirements and manufacturer's recommendations, a hazards analysis to identify, evaluate and control hazards involved in processing and handling combustible liquids and a fire and emergency action plan consistent with available equipment and personnel to respond to fires and related emergencies. Applicable sections within NFPA 30 and 85 include but are not limited to:Operator Training for thermal oil systems specifically and for fired equipment is required under: NFPA 30.19.4.7.2: Recirculating Heat Transfer Systems, Operations, Operator Training. NFPA 85.4.3.2: Coordination of Design, Construction, and Operations. NFPA 85.4.4.2.1: Operator Training. NFPA 85.4.5: Basic Operating Requirements. Established Operating Procedures are required under: NFPA 85.4.4.2.1.2 Operator Training NFPA 85.4.4.2.1.2.1 Operator Training NFPA 85.4.4.2.1.6 Operator Training NFPA 85.4.5.2 Basic Operating Responsibilities NFPA 85.4.5.6 Basic Operating Responsibilities Safety Interlock Inspection, Testing and Calibration Program is required under: NFPA 30.19.4.7.3 Operation Maintenance Training is required under: NFPA 85.4.4.2.2.1 Maintenance Training NFPA 85.4.4.2.2.2 Maintenance Training Established Maintenance Procedures are required under: NFPA 85.4.4.2.2.2 Maintenance Training NFPA 85.4.4.2.2.4 Maintenance Training A Maintenance and Equipment Inspection Program is required under: NFPA 85.4.4.1 Maintenance and Equipment Inspection A Hazard Evaluation Program is required under: NFPA 30.17.15.2 Management of Operations Hazards NFPA 30.17.15.3 Management of Operations Hazards NFPA 30.19.4.7.1 Operations A Written Emergency Action Plan is required under: NFPA 30.17.15.4 Management of Operations Hazards NOTE: ABATEMENT CERTIFICATION REQUIRED

The employer did not ensure that each employee working from the top of tractor trailers with unprotected sides and edges was protected from falling at employer's installed fixed unloading station. Among other methods, one feasible and acceptable method to correct the hazards is to provide fall protection for employees walking/working on tractor trailers. NOTE: ABATEMENT DOCUMENTATION REQUIREDATION

Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) Jobsite: Facility, Main Floor - The employer did not enforce the use of the seat belt when an employee was operating a powered industrial truck, Crown SC, which was provided with a seatbelt by manufaturer. Observed on or 06/16/10. One feasible and acceptable method of abatement would be to require the employee to wear and enforce the use of the seatbelt to all forklift operators in the facility while they operate this equipment. NOTE: ABATEMENT CERTIFICATION REQUIRED
