Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing injuries from a falling load while using a lifting device which was not determined to be safe. (a)Base Department - Employees use lifting devices made in house to lift the side walls of a trailer. The employer did not insure that the lifting devices were labeled with the rated capacity, manufacturer name and address and a serial number, on or about May 13, 2010. (b)Fabrication Department - An employee uses a lifting device made in house to lift the dies for the press brake. The employer did not insure that the lifting device was labeled with rated capacity, manufacturer name and address and a serial number, on or about May 13, 2010. ABATEMENT NOTE: Among other methods, one feasible means of abatement would be contained in ASME B30.20- 2003 Below the Hook Lifting Device in that the company would have an engineer determine the rated capacity and mark the information along with the manufactures name and address, serial number and the lifting device weigh if over 100 lbs on the device. The device must also be inspected periodically, proof tested and certified and insure that the weight of the device is figured into the weight that can be lifted. VERIFICATION REQUIRED
