Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazards. a) On March 26, 2010, at the site located at 251 N. Milwaukee Avenue in Wheeling, Illinois 60090, Argo Roofing Company provided a Garlock Equipment Company 300 lbs. ( A frame) Hand Hoist that was not equipped with approved counterweights. Among other methods, feasible and acceptable means of abatement is to use counterweight materials specified by the hoist manufacturer as described in the operating instructions and warning section of the Garlock Equipment Company 300 lbs (A frame) Hand Hoist owner's manual. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
