Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which are free from
recognized hazards that are causing or likely to cause death or serious
physical harm to his
employees in that employees were exposed to:
(a): Auto body / repair shop: On or about 11/09/10, and at times prior
thereto, employees
were exposed to a struck by and crushing hazard while elevating vehicles
in auto lifts such
as, but not limited to the two post Challenger lift #247622A, without
properly functioning
locks on the lifting arms.
(b): Auto body shop: On or about 11/09/10, and at times prior thereto,
employees were
exposed to a struck by and crushing hazard while elevating vehicles in the
two post
Challenger lift #247622A without a properly functioning overhead stop.
(c): Auto body shop: On or about 11/09/10, employees were exposed to a
struck
by and
crushing hazard while elevating a vehicle in the two post Rotary lift
#CRZ07L0200 with an
unapproved lifting accessory in the form of a wooden block.
(d): Auto body / repair shop: On or about 11/09/10, and at times prior
thereto, employees
were exposed to a struck by and crushing hazard while elevating vehicles
in auto lifts such
as, but not limited to the four post Hunter #EP6663 and the two post
Rotary #CRZ07L0200
with inadequate and/or ineffective training.
LITHIA CHRYSLER JEEP DODGE WAS PREVIOUSLY CITED FOR A VIOLATION OF
THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS
CONTAINED IN OSHA INSPECTION NUMBER 311222350, CITATION NUMBER 01,
ITEM 001 AND WAS AFFIRMED AS A FINAL ORDER ON JULY 12, 2010, WITH
RESPECT TO A WORKPLACE LOCATED AT 4025 10TH AVE. SOUTH, GREAT
FALLS, MT.
Among other methods, one feasible and acceptable method to correct the
hazard noted is to
follow the requirements in ANSI/ALI ALOIM 2008 which include, among other
requirements, the following:
1. Provide effective training to employees on the proper use and care of
auto lifts.
2. Institute a preventive maintenance program according to the
manufacturer's specifications.
