Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF FALLS: a)North side of building, on or about 6-2-10: Employees were climbing a Hydro- mobile mast tower, 64 feet 6 inches in height, without fall protection. Among other methods, one feasible and acceptable method of abatement to correct this hazard is: Comply with the Hydro-mobile Operators Manual, Page 21, paragraph 3, stating: "The use of fall protection equipment is mandatory when climbing or descending the tower if exposed to a height over 10 feet. Use full body harness and self retracting lifeline."
