Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: On or about 6/13/11, Chiulli #160, Route 80, Smyrna: Well control was not maintained at all times. The Blow Off Preventor (BOP) was not maintained in an operable condition. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that Blow Off Preventors are maintained at all times as per API RP54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, Section 6.1.ion
