Section 5(a)(1) of the 1970 OSH Act: The employer did not furnish each of
his employees
conditions of employment and a place of employment free from recognized
hazards
that are
causing or are likely to cause death or serious physical harm to
employees, in that,
employees were exposed multiple injuries resulting form the employee
striking the ground
and or the mast of the forklift following a fall. The platform and
employee were elevated by
a Cat, Ring Lift forklift, Model C6000.  A wood pallet was used as a
platform; the pallet
was not secured to the lifting carriage and/or forks nor was it designed
for that purpose. The
employee was wearing a safety belt, with a six foot lanyard attached to
the top rail of load
guard.
a) Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to secure the personnel platform to the lifting carriage
and /or forks and
install a midrail and a 4 inch toe board in the guardrail system;  Use an
elevating
work platform designed specifically for elevating employees; Install a
work platform
or use a ladder.
