Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between, struck-by, and falling into an unprotected excavation while working from the bucket of an excavator: a. On or about August 5, 2010 on Cullman Street, Montgomery, AL: An employee was working from the lowered Caterpiller 330C Excavator bucket positioned 7 feet from the end of a 11 foot 8 inch deep excavation while cutting off the end of the old 6 inch sewer line, which is prohibited as described in the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators. Among others, a feasible and acceptable method of abatement would be to remove the excavator bucket from the trench while employees are cutting or removing old pipe and work from stable soil.e
