Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck-by vehicular traffic due to lack of wearing of reflective garments/vests. This condition occurred on or about June 30, 2010 while road patching was being preformed. Wear reflective garments/vest when working in areas were there is a hazard of being struck-by vehicular traffic. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to act in accordance with 23 CFR Part 634 Section 634.3, Worker Visibility, which states: All workers within the right-of-way of a Federal-aid Highway who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction equipment within the work area shall wear high-visibility safety apparel.: a)Street - Two employees were observed not wearing reflective vests while working in the road where vehicular traffic was present exposing them to a struck-by hazard, on or about 06/30/10.
