North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)loading dock, employees have been injured, one on October 22, 2008 and one on February 24, 2010, due to switchers moving trailers away from the dock while the employees were loading/unloading materials with the forklift. Among other methods, one feasible and acceptable method to abate this hazard is to document, implement, and enforce the procedures required for switchers to prevent moving trailers from the dock.
