Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by injuries: (a)Celestial Seasonings at 6325 Spine Road, Boulder, CO 80301: Employees of Celestial Seasonings were exposed to struck-by injuries as a result of the practice of tilting unsecured polypropylene tanks in the fermentation room for the purpose of fully draining the tanks. On September 23, 2010, an employee was seriously injured while engaging in the practice. The employee was tilting a second tier fermentation tank so its contents would more fully drain from its drain opening. The tank slipped on its rack and hit an unsecured third tier fermentation tank, causing the third tank to fall, striking and seriously injuring the employee.
