Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and/or crushing hazard. a)Side Yard, Establishment Site: An employee, struck-by and injured while removing the guardrail system of a Skyjack Model 3220 scissor lift, did not follow the safety guidelines outlined in the Skyjack Model 3220 Operating Manual, on or about 1/12/2012. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to: 1: Follow the safety precautions that would prevent a crushing hazard as referenced in the Skyjack Operating Manual. 2: Follow the safety warning that would prevent the use of a scissor lift that does not appear to be working properly as referenced in the Skyjack Operating Manual. 3: Follow the maintenance and inspection schedule that requires a daily visual and operational inspection of the control switches as outlined in the Skyjack Operating Manual. 4: Repair items found to be faulty or not working properly to include the LIFT/DRIVE/STEER Enable Trigger Switch. This device, when working properly, must be lifted and held continuously while engaging either the lift, drive or steer functions as outlined in the Skyjack Operating Manual. 5: Follow the safety warning to protect against unintended movement of the machine by pushing in the emergency stop button after arrival at the desired location as outlined in the Skyjack Operating Manual. Note: This warning is shown in three (3) different locations on page 27, and repeated on page 29, of the manual. 6: Follow the safety warning to not operate this machine without proper authorization and training as outlined in the Skyjack Operating Manual. 7: Follow the safety warning that prevents non-qualified personnel from operating machinery during loading / unloading as outlined in the Skyjack Operating Manual. 8: Follow the safety warning that requires the parking brake be re-engaged immediately after reaching the desired location as outlined in the Skyjack Operating Manual. 9: Follow the lifting instructions found in the Skyjack Operating Manual stating that control box must be secured to the railings or removed, and the emergency main power disconnect switch must be in the "OFF" position.t
