Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : (a) Plant Floor - on or about 6AUG10, an employee was observed to operate a Toyota electric forklift with out the seat belt fastened. Abatement Note: Among other methods, one acceptable means of abatement would be to use the seat belt in accordance with Consensus Standard ANSI/ITSDF Safety Standards for Low and High Reach Lift Trucks B56.1-2009, Section 5.3.19: which states "An active operator protection device or system, when provided, shall be used.
