Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of crushing injuries associated with the
rollover of a lift trucks
without the use of an operator restraint system.
a)  Warehouse - On or about May 25, 2011, employees were observed
operating a TCM
propane forklift, TCM Model #FCG25 to move fifty-five (55) gallon drums of
hydrochloric acid and boxes of one (1) gallon bottles of dispensed acid
without using the
existing seatbelt.
ABATEMENT NOTE: Among other methods of abatement, one feasible and
acceptable method
of abatement would be to utilize the installed restraint system in
accordance with ANSI B56.1-
2005 "Safety Standards for Low Lift and High Lift Trucks", Section 5.3.19.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, date
and method of abatement,
and states employees and their representatives were informed of this
abatement.  Abatement
documentation shall include documents demonstrating that abatement is
complete, such as
evidence of the purchase or repair of equipment, photographic or video
evidence of abatement
or other written records.
