Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards associated with the buildup of combustible PVC resin dust: For Burke Industries' indoor PVC Resin Silo area and mixing/blending room at 37235 State Road 19, Umatilla, FL 32784, as observed on or about 7/14/2010: a) No engineering controls in the form of a continuous suction system were in place in the mixing room to capture the fugitive dust released from the resin hopper, screw conveyor, and rotary mixer. During normal operation, dust was released from this equipment which resulted in dust accumulation up to 1 in. deep on the floors and elevated surfaces. The dust was analyzed to be combustible with a Kst of 14.87 bar/m*s. ABATEMENT NOTE:(s) Among other methods, means of feasible and acceptable abatement include compliance with National Fire Protection Agency (NFPA) 654 "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids 2006 Edition" These requirements include but may not be limited to: installation of a vacuum system at the points where dust is liberated from the equipment in order to capture the fugitive dust emissions.
