Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)At the Wetumpka High School Gymnasium Wetumpka, Alabama: On October 6 and at times prior, the employer failed to ensure that employees working on the steel structure using a Simon MP60 serial number 1341 aerial lift, Manufacture Date 1998 were tied off to the basket using proper tie off points exposing themselves to falls hazards of 9 feet. Among other a feasible means of abatement would include using the proper tie off points supplied in the aerial lift.
