North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to thrown against, struck by and crushed by hazards while operating the forklift: a)170 Flair Fold Dr. - where the operator of the DAEWOO GC25E 4,000 pound capacity forklift did not wear the installed seatbelt during daily operations. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have employees fasten the installed seat belt when operating equipment. Reference: ASME B56-1-1993, Paragraph 5.3.19: An active operator protective device or system, when provided, shall be used."
