North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to struck by hazards:
a)Log laydown yard - where the Komatsu WA380 used to unload logs from over
the road trucks
was observed to be in use without a working backup alarm.
Reference:  ISO 9533-8.1 states "The reverse warning alarm shall be
automatically activated
upon the machine being activated for traveling in reverse".
Abatement note:  Among other methods, one applicable and feasible method
would be to
replace the existing backup alarm with a working alarm, that is audible
above the surrounding
noise.
