Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On or about March 15, 2011, or at times prior thereto, at the job site, employees were observed climbing on guardrails of a scissor lift in order to access a steel frame building approximately 27'10" high. This exposed employees to the hazard of falling. A recognized and feasible means of abatement to correct this hazard is to ensure that employees stay within the boundaries of the guardrails and do not sit, stand, or climb on the guardrails in accordance with manufacturer's instructions.
