Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On or about April 14, 2011, and at times prior thereto, at the job site, an employee was observed climbing and standing on the guardrails of a scissor lift, approximately 28 feet to 32 feet high. This exposed the employee to the hazard of falling. A recognized and feasible means of abatement to correct this hazard is to ensure that employees stay within the boundaries of the guardrails and do not sit, stand, or climb on the guardrails in accordance with manufacturer's instructions.
