Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that: Employees
were exposed to the hazard of being struck by a falling spreader bar:
LOCATION:  Job Site, Trailer Compound/Storage Area.  On or about: 11/09/11
a) Employees used a rough terrain JLG Lull forklift with a model 1190
spreader bar attachment
to move rebar and other materials.  The locking pins of the attached
spreader bar were not
inserted and secured, allowing the spreader bar to come off the forks of
the forklift.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
a) Follow the Installation "On the forks installation" instructions on
page 2 of the Forklift
Spreader Bar-Model 1190 Safety Instructions and Operator's Manual:
"Insert the forks into the fork pockets and then slide the spreader bar
all the way onto
the forks so the pin tabs extend behind the back of the fork. Insert the
fork locking pins
in each side and secure them with hair-pins to lock the spreader bar to
the forks".
b) Follow the Caution instructions on page 2 of the Forklift Spreader
Bar-Model 1190
Safety Instructions And Operator's Manual:
#2: "Risks are high for serious injury when working around suspended
loads. The
operator must avoid carrying the load over people and it is best to have a
10' foot rule.
This requires that no one is allowed to be within 10 feet of the area in
which the load
would fall if a failure occurred".
NOTE: The employer is required to submit abatement certification for this
item in
accordance with 29 CFR 1903.19.
