Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Paint booth - There was no means of fall protection for a painter who was required to stand on the tops of objects being painted such as, but not limited to Sea Box quadruple containers. The height of a quadruple container was approximately 81 inches. On or about 12/15/10. One feasible and useful method of abatement would be to provide a means of fall protection for the employee such as, but not limited to, wearing a harness and lanyard, tied off to an anchor point. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
