Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Route 25 Reconstruction and Widening of Road- SanSung and Doosung excavator shovels pins were modified with 6 and 2 inch bolts and nuts, instead of the original pins. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.To follow the American Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are replaced, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service.
