Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards that are causing or likely to cause death or serious physical harm to employees. On or about 03/30/2011 and at times prior thereto at the jobsite located at 6701 University Ave. Lubbock, TX., least one employee who was lifted to an elevated work area while standing on a pallet on the forks of a fork truck, was exposed to the hazard of falling to the lower level. Among other methods, recognized and feasible means of abatement to correct these hazards include, but are not limited to: a) Provide and utilize a ladder at all personnel points of access where there is a break in elevation of 19 inches or more; b) provide and utilize a work platform as specified by the manufacturer of the lift truck.
