Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about February 2, 2011 and times prior thereto, the employer failed to ensure that a seat belt was worn by the operator of the Doosan Daewoo fork lift exposing him to the hazard of being ejected in the event of a vehicle rollover. One feasible method of abatement would be to enforce the use of seat belts provided by the manufacturer of the truck.
