Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed tohazards while accessing the different elevated heights on
the impact crusher:
On or about January 20, 2011, in the High-bay Area, employee(s) used a
defective plastic
reinforced (fiberglass) ladder to access various sections of the company's
impact crusher. The
fiberglass ladder had structural defects that included damaged side rails
and bent rungs at the top
and at the base of the ladder. Employee(s) were exposed to fall hazards of
approximately 20-25
feet while using the damaged ladder.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow American National Standard for Ladder - Portable Reinforced
Plastic - Safety
Requirements, ANSI A14.5 - 2007, Section 9 - Selection, Care and Use
requirements as
applicable.
