29 CFR 1910.134(d)(3)(i)(A):  The employer did not use the assigned protection factors listed in Table 1 to select the appropriate respirator that meets or exceeds the required level for proper employee protection:    On or about January 23, 2013, the laborer in the high bay area was not wearing proper respiratory protection while exposed to total dust at a level 11.28 times the permissible exposure limit (PEL), in that the half-mask air purifying respirator used is rated for exposures up to 10 times the PEL.

29 CFR 1910.1000(a)(2):  Employee(s) were exposed to an airborne concentration of respirable dust listed in table Z-3 in excess of 5 milligrams per cubic meter as an 8-hour Time Weighted Average concentration:    On or about October 3, 2012, the laborer in the high bay area was exposed for 433 minutes to 8.26 mg/m3, 1.65 times the PEL.  Zero exposure is assumed for the time not sampled.

29 CFR 1910.1000(e):  Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    On or about October 3, 2012, controls were not in place for the employees including, but not limited to those as described in Citation 1, item 2(a):    General methods of control applicable in these circumstances include, but are not limited to the following:    1)	 Evaluate the high bay crushing system for a possible containment of the process with local exhaust ventilation and removal/capture system to ensure the most adequate removal of the dust from the worker exposure    2)	Re-evaluate the existing work practices and/or administrative controls in both the high bay areas to reduce worker exposures to the airborne contaminants.    Step 1: Effective respiratory protection shall be provided and used by exposed employees as an interim protective measure until feasible engineering and/or whatever such controls fail to reduce employee exposure to within permissible exposure limits.  (Abatement must be completed by ***30 days** after issue)    Step 2:  Submit to the Area Director a written plan of abatement outlining a schedule for the implementation of engineering and/or administrative measures control employee exposure to hazardous substances in this citation.  This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation:    1)	 Reevaluation of the current engineering/administrative control options;    2)	Selection of optimum control methods for this system and completion of design;    3)	Procurement, installation, and operation of selected improvement measures; and    4)	Testing and acceptance or modification/redesign of controls.    NOTE:  All proposed control measures shall be approved for such particular use by a competent industrial hygienist or other technically qualified person.  (Abatement must be completed by **60 days** from issuance)    Step 3:  Abatement shall have been completed by the implementation of feasible engineering and/or administrative controls upon verification of their effectiveness in achieving compliance.  (Abatement must be completed by **90 days** from issuance)

29 CFR 1910.1000(a)(2):  Employee(s) were exposed to an airborne concentration of  total dust listed in table Z-3 in excess of 15 milligrams per cubic meter as an 8-hour Time Weighted Average concentration:    On or about January 23, 2013, the laborers in the high bay area were exposed to total dust for 375 minutes to 66.1 mg/m3, approximately 4.4 times the PEL and for 370 minutes to 169.2 mg/m3, approximately 11.28 times the PEL.  Zero exposure is assumed for the time not sampled.    Note:  A-TEN-C was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1000(a)(2), which was contained in OSHA inspection number 315249979 citation number 1, item number 3a and was affirmed as a final order on May 3, 2011, with respect to a workplace located at 1536 Front Street, Newton Falls, OH.
