General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that employees were exposed to hazardous conditions when the employee was exposed to a crushing hazard: a) Work production area near the custom area: An employee was exposed to a crushing hazard while standing in a Vestil Manufacturing Corporation Work Platform model WP-3737FD attached to an industrial truck. The work platform was not designed to travel laterally while occupied, on or about 2/17/11. One feasible and useful method of abatement would be to remove the person from the platform before moving the forklift. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
