furnish employment and a place of employment which was free from
recognized hazards that
were likely to cause death or serious physical harm to the employees, in
that employees were
exposed to be struck by a moving suspended load that was being lifted by a
wheel loader:
a.Yard Area: Employees working on a retaining wall, were exposed to being
struck by a jersey concrete barrier that was being suspended on the bucket
of
the 2005 Hyundai wheel loader, serial# LF011540, model# 740-7, by a 6'
steel chain, as determined on September 22, 2011.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to follow the Manufacturer's Operator manual which requires that this
machine be used
only for excavation and loading, and not for pulling up materials.
