Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by falling, unsecured equipment because the equipment had not first been securely connected to a lifting/holding device before the removal of the guy wires which had been holding it erect. (a)Mosbacher Energy's Herrin 20-15, #1 Deactivated Oil Well site off Buford-Gandy Road in Section 20, T9N, R17W, Wayne County, Mississippi - On or about Monday, April 25, 2011 employees were exposed to having an 800 pound un-guyed flare stack fall on them due to the employer's decision to release the support tension being supplied from/by three (3) 3/16 inch diameter guy cables, which had been connected to the flare stack and their ground auger-anchors prior to securing the top of the flare stack to the load line of an awaiting crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to first connect the load line of a crane to the flare stack before removing tension from any of its guy wires.
