North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to:
a) Dock area outside warehouse#1 - daily visual inspections of a one ton
Dayton hoist was not
performed before each use and could not be verified.
Abatement Note:  Among other methods, one feasible and acceptable
abatement method to correct
these hazards is to comply with 29 CFR 1910.179(j)(1)[i-ii]:
1)Prior to initial use all new and altered cranes shall be inspected to
insure compliance with the
provisions of this section.
2)Inspection procedures for cranes in regular service was divided into two
general classifications
based upon the intervals at which inspections should be performed.  The
intervals in turn are
dependent upon the nature of the critical components of the crane and the
degree of their
exposure to wear, deterioration, or malfunction.  Frequent inspections are
to be daily to
monthly intervals and periodic inspections are from 1 to 2 month
intervals.s
