Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about July 8, 2011, employee(s) were exposed to an oxygen deficient atmosphere with oxygen levels measured in the range of 10.3%-19.4%, with the safe lower limit for oxygen being 19.5%. b) On or about July 21, 2011, employee(s) were exposed to an oxygen deficient atmosphere with oxygen levels measured in the range of 19.2%-19.4%, with the safe lower limit for oxygen being 19.5%. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD,INCLUDE BUT ARE NOT LIMITED TO: 1. Adjust tunnel freezer ventilation system to prevent frost accumulation which would allow the spent vapor to be removed to the outside of the building. 2. Install a fixed monitoring system to warn employees when an oxygen deficient atmosphere occurs. 3. Compliance with the guidelines outlines in the Compressed Gas Association, Inc. Safety Bulletin 2, "Oxygen Deficient Atmospheres" 2007 Edition.
