Health Act of North Carolina: The employer did not furnish to
each of his employees conditions of employment and a place of employment
which were free from recognized hazards that were causing
or likely to cause death or serious physical harm to employees in that
employees were inside an elevated work platform of an unattended
powered industrial truck:

Truck was left unattended with 2 employees on
suspended platform.
Abatement Note: Among other methods, one feasible and acceptable abatement
method to correct this hazard is to follow the
requirements of 29 CFR PART 1910.178(m)(5)(i) of the Occupational Safety
and Health Standards for General Industry which
states,"When a powered industrial truck is left unattended, load engaging
means shall be fully lowered, controls shall be neutralized,
power shall be shut off, and brakes set. Wheels shall be blocked if the
truck is parked on an incline."ed,
