Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employee(s) were exposed to possible falls and/or being struck and/or crushed by a manlift that may fail during use: THE EMPLOYER DID NOT ENSURE THAT THE FOUR (4) IN-HOUSE METAL- FABRICATED MANLIFT(S) ATTACHED TO PROPANE FORKLIFT TRUCK(S) WERE APPROVED BY A QUALIFIED ENGINEER PRIOR TO EMPLOYEES USING THEM FOR MAINTENANCE PURPOSES. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS APPARENT HAZARD IS TO USE A PLATFORM THAT MEETS THE DESIGN REQUIREMENTS CONTAINED IN AMERICAN NATIONAL STANDARDS INSTITUTE ANSI B56.1-2005 ENTITLED "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS". IN PARTICULAR, COMPLY WITH THE FOLLOWING PROVISIONS OF THE STANDARD: 1. Have a qualified engineer evaluate the structural integrity of the platform, including all the sections to ensure that the platform has a structural safety factor of not less than 3 to 1 (ANSI B56.1-2005, paragraph 7.37.1(g)). 2. Provide a means to securely attach the platform to the lifting carriage or forks of the fork truck (ANSI B56.1-2005, paragraph 7.37.3(c)). 3. Ensure that the lifting platform is designed so that the floor of the platform that personnel stand on is not more than 200 mm (7.8 inches) above the level of the forks (ANSI B56.1-2005, paragraph 7.3.3(b). 4. Ensure that the maximum load including personnel and equipment, the weight of the empty platform, and the minimum capacity of the truck on which the platform can be used is prominently displayed on the platform. Note: The combined weight of the platform load and personnel cannot exceed one-half of the capacity of the fork truck on which the platform load is used. (ANSI B56.1-2005 paragraph 7.37.3(i). 5. There shall be a minimum floor space of 450 mm (18 inches) X 450 mm (18 inches) for each platform occupant.
