Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while being elevated on a picker: a) Warehouse Employees are exposed to fall hazards when they are elevated 4 ft on a picker while not wearing fall protection. Violation disclosed on or about 06/30/2011. Among methods, all of the following are feasible and acceptable means of abatement: 1. Whenever a truck is used to elevate personnel be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyard(s), or deceleration devices, etc., are in place and properly used, in accordance with ANSI/ITSDF B56.1-2009 Safety Standard for Low Lift and High Lift Trucks, Section 4.17.2 paragraph (c).
