29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). Warehouse area - On or about July 17, 2013, the employer did not ensure that each employee who was allowed to operate the Crown stand-up and Crown order picker forklifts were trained and certfied in accordance with paragragh (l).

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Warehouse area - On or about July 17, 2013, the following powered industrial vechicles were not removed from service. 1. Crown standup (serial #14277201 - brake not operative 2. Raymond rider #104 - horn not operative and battray cable wires not completly guarded.
