General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from an e levated personnel platform. On or about January 27, 2011, two employees were wor king from a trash box that was elevated by a SkyTrak Model #6036 rough terrain, telescoping boom forklift up to approximately 32 feet high to apply caulk to the expansion joints on building #8. The box was used as a personnel platform that did not meet the manufacturer's requirements for safely lifting employees with t he forklift. Deficiencies with the platform include: a) The platform was not des igned with a slip resistant surface. b) Information indicating the maximum work load for personnel and equipment and the weight of the empty platform was not di splayed. c) The platform was not equipped with at least one lanyard anchorage point for e ach occupant. Among others, one feasible and acceptable means of abatement would be to follow the JLG Industries, Inc. approved fork mounted personnel work plat form policy letter dated February 21, 2007. Pursuant to 29 C.F.R. 1903.19, withi n ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including desc ribing the steps that it is taking to ensure that employees are elevated in pers onnel platforms that are only approved by the manufacturer.
